General Terms and Conditions (GTC) of the hotel ‘Landgasthof Hirschen GbR’
1 Scope of application
1.1 These General Terms and Conditions apply to all contracts for the rental of hotel rooms for accommodation purposes, as well as to all other related services and deliveries of the hotel.
1.2 Deviating terms and conditions of the guest shall not apply unless they have been expressly recognised by the hotel in writing.
2 Conclusion of contract, contractual partner, limitation period
2.1 The contract is concluded upon acceptance of the guest’s application by the hotel. The hotel is free to confirm the room booking in text form.
2.2 The contractual partners are the hotel and the guest. If a third party has booked on behalf of the Guest, it shall be jointly and severally liable to the Hotel together with the Guest.
2.3 All claims against the hotel are generally subject to a limitation period of one year from the commencement of the statutory limitation period.
3 Services, prices, payment, offsetting
3.1 The hotel is obliged to keep the rooms booked by the guest available and to provide the agreed services. In the event of overbooking or technical faults that make it impossible to provide the accommodation, the hotel reserves the right to accommodate the guest in alternative accommodation at no extra charge.
3.2 The Guest is obliged to pay the Hotel’s agreed prices for the provision of the room and the other services utilised by the Guest.
3.3 Hotel invoices are payable immediately upon receipt without deduction. Default occurs if the guest does not pay within 14 days of the due date and receipt of the invoice.
3.4 The Guest may only offset or reduce claims of the Hotel with undisputed or legally established claims.
4 Withdrawal by the guest (cancellation, no-show)
4.1 Cancellation by the Guest of the contract concluded with the Hotel requires the Hotel’s written consent.
4.2 In the event of late cancellation or no-show by the Guest, the Hotel shall be entitled to charge the agreed remuneration.
5 Cancellation by the hotel
5.1 The hotel is entitled to withdraw from the contract for objectively justified reasons, for example in the event of force majeure or other circumstances for which the hotel is not responsible and which make fulfilment of the contract impossible.
6 Room provision, handover and return
6.1 Booked rooms are available to the guest from 16:00 on the agreed day of arrival. The guest is not entitled to earlier availability unless the hotel has given its extraordinary consent.
6.2 On the agreed day of departure, the rooms must be vacated and made available to the hotel by 11.00 a.m. at the latest.
7 Liability of the hotel
7.1 The hotel is liable for damages resulting from injury to life, limb or health, as well as for other damages resulting from an intentional or grossly negligent breach of duty.
7.2 The hotel is liable for items brought into the hotel in accordance with the statutory provisions.
8 Final provisions
8.1 Amendments or additions to the contract or these General Terms and Conditions must be made in writing.
8.2 German law shall apply. The place of jurisdiction is the registered office of the hotel.
